Please read these terms of service carefully before using the EduAtlas platform. By accessing or using EduAtlas in any manner, you agree to be bound by these terms in their entirety. If you do not agree to these terms, you must immediately cease all use of the platform. These terms constitute a legally binding agreement between you and Golding Education Ltd.
"Company," "we," "us," or "our" means Golding Education Ltd, a company incorporated and registered in England and Wales under Company Registration Number 16396444, registered with the Information Commissioner's Office under Registration Number 00013805394, reachable at hello@eduatlas.org.
"Platform" means the EduAtlas website accessible at eduatlas.org, all associated subdomains, application programming interfaces, mobile-optimised interfaces, and all related services, features, content, and functionality made available by the Company, whether accessed through a browser, application, or any other means.
"User," "you," or "your" means any individual who accesses, registers for, or uses the Platform in any capacity, including but not limited to educators, school administrators, institutional representatives, and visitors.
"Educator" means a User who has registered for an account on the Platform as a professional educator, teacher, administrator, or other education professional.
"School" or "Institution" means any educational institution, school, college, university, or other education provider whose profile appears on or who accesses the Platform.
"Content" means all information, data, text, photographs, profiles, employment histories, messages, notes, endorsements, job listings, and other materials submitted to, posted on, transmitted through, or made available via the Platform by any User or by the Company.
"School Data" means the publicly available institutional information sourced from governmental datasets and other public sources that the Company uses to populate school pages on the Platform, including but not limited to school names, addresses, contact details, and programme information.
By accessing or using the Platform, you represent, warrant, and agree that: (a) you are at least eighteen (18) years of age; (b) you have the full legal capacity to enter into a binding contract; (c) you are a professional educator, education professional, school administrator, or institutional representative, or are accessing the Platform for purposes directly related to education; (d) all information you provide to the Company is accurate, current, and complete; and (e) your use of the Platform does not violate any applicable law or regulation.
The Platform is strictly prohibited for use by persons under the age of eighteen (18) years. The Platform is not designed for, directed at, or intended to be used by students in any capacity. By creating an account, you confirm that you are a professional adult educator or education professional. Any person who registers falsely as an adult educator may have their account immediately terminated and may be subject to legal action.
The Company reserves the right to refuse access to or terminate the account of any User who does not meet the eligibility requirements set out in these Terms, at its sole discretion and without prior notice.
To access certain features of the Platform, you must register for an account. You may register using your electronic mail address, or by authenticating through a third-party provider such as Google, subject to the terms and policies of that provider. By using a third-party authentication provider, you authorise the Company to receive and process the profile information made available by that provider in accordance with our Privacy Policy.
You are solely and entirely responsible for: (a) maintaining the strict confidentiality of your account credentials; (b) all activity that occurs under your account, whether or not authorised by you; (c) notifying the Company immediately upon becoming aware of any unauthorised access to or use of your account; and (d) ensuring that you log out of your account at the end of each session on any shared device.
The Company will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. You may not share your account with any other person, transfer your account to any other person, or permit any other person to access the Platform using your credentials.
The Company reserves the right to require you to update your credentials at any time and to suspend or terminate your account if it reasonably believes that your account has been compromised or is being used in an unauthorised manner.
The Platform enables Educators to create and maintain professional profiles containing employment history, educational history, professional contributions, profile photographs, and other professional information. You represent and warrant that all Content you submit to the Platform is accurate, truthful, and does not misrepresent your professional qualifications, experience, or credentials. The submission of false, misleading, or fabricated professional information constitutes a material breach of these Terms and may result in immediate account termination.
By submitting Content to the Platform, you grant to the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, display, distribute, and make available such Content in connection with the operation of the Platform and the Company's business, including but not limited to displaying your profile to other Users, institutions, and visitors, and including your profile in search results and aggregated analyses. This licence continues for as long as your Content remains on the Platform and for a reasonable period thereafter in connection with the wind-down of services.
You retain ownership of all Content you submit to the Platform. The Company does not claim ownership of your professional information, profile photograph, or other personal Content. The licence granted above is solely for the purpose of operating and improving the Platform.
You are solely responsible for all Content you submit. The Company does not endorse, verify (except as provided through the community verification feature), or guarantee the accuracy of any User-submitted Content and accepts no liability for the accuracy or completeness of profiles, employment histories, or other User-generated information.
The Platform operates a community verification system that enables Educators who have worked together at the same institution during overlapping periods to vouch for one another's professional identity. Verification is a confirmation of professional association, not an endorsement of professional competence, character, or suitability for employment. The Company makes no representation as to the accuracy, reliability, or completeness of the verification system.
The Platform enables verified professional connections to leave structured professional notes on one another's profiles. By submitting a professional note, you represent and warrant that: (a) you have a genuine professional relationship with the subject of the note corresponding to the relationship declared; (b) the content of the note is accurate and truthful; (c) the note does not contain defamatory, misleading, discriminatory, or otherwise unlawful content; and (d) you have not received any consideration, inducement, or instruction from any person in connection with the submission of the note.
The Company reserves the right to remove any professional note that it reasonably believes violates these Terms, applicable law, or the professional standards expected on the Platform. The Company is not a publisher of professional notes and accepts no liability for the content of notes submitted by Users. Any disputes regarding the content of professional notes shall be directed to hello@eduatlas.org.
The Platform displays job listings sourced from schools and educational institutions. The Company makes no representation or warranty as to the accuracy, availability, or legitimacy of any job listing displayed on the Platform. The Company is not an employment agency, recruitment consultancy, or party to any employment relationship between an Educator and a School. Any employment relationship formed as a result of connections made through the Platform is solely between the Educator and the School concerned, and the Company accepts no liability for the terms, conditions, or outcome of any such employment relationship.
Schools and institutional representatives who post job listings on the Platform represent and warrant that: (a) the listed position is genuine and currently available; (b) the listing complies with all applicable employment law, including but not limited to the Equality Act 2010 and all applicable anti-discrimination legislation in the jurisdiction of the role; (c) the listing does not contain false or misleading information; and (d) they have the authority to recruit for the listed position.
The Platform's feed personalisation system uses information from an Educator's profile to rank and suggest job opportunities. This personalisation is provided as a convenience and does not constitute a professional recommendation or guarantee of suitability. Educators are solely responsible for assessing their own suitability for any role to which they apply.
The Platform provides an optional feature enabling Educators to contribute anonymised salary information for the purpose of generating aggregated regional compensation data. By contributing salary data, you acknowledge and agree that: (a) your individual salary will never be displayed or disclosed to any other User or third party; (b) your data will only be incorporated into aggregate statistics once a minimum threshold of contributions from multiple independent sources has been met; (c) the aggregated compensation data produced by the Platform is provided for informational purposes only and does not constitute financial or employment advice; and (d) actual compensation for any role will depend on a range of factors outside the Platform's knowledge or control.
You agree that you will not, under any circumstances, do any of the following:
SCRAPING AND AUTOMATED ACCESS. You must not access, collect, harvest, scrape, crawl, index, copy, or extract any data, Content, or information from the Platform by automated means, including but not limited to bots, spiders, scrapers, crawlers, data mining tools, screen scraping software, or any other automated or programmatic method, without the prior express written consent of the Company. Automated access to the Platform, including access to school pages, educator profiles, job listings, salary data, or any other data or Content, is strictly prohibited. The Platform's data, including the school database, educator network, job listings, and compensation intelligence, constitutes proprietary information of the Company and is protected by applicable database rights, copyright, and other intellectual property laws. Any attempt to replicate, reproduce, or commercially exploit the Platform's data without authorisation constitutes a material breach of these Terms and may give rise to civil and criminal liability.
IDENTITY AND CREDENTIAL MISREPRESENTATION. You must not impersonate any person or entity, misrepresent your professional qualifications or employment history, create a false professional identity, register multiple accounts, or submit professional notes or verifications on behalf of persons who have not authorised such action.
INTERFERENCE WITH PLATFORM INTEGRITY. You must not attempt to probe, scan, or test the vulnerability of any system or network associated with the Platform; attempt to circumvent any security, authentication, or access control measure; introduce any virus, worm, malware, ransomware, or other harmful code; attempt to intercept or redirect any communication on the Platform; or engage in any denial of service attack or similar conduct.
HARMFUL AND UNLAWFUL CONTENT. You must not submit, post, transmit, or otherwise make available through the Platform any content that is defamatory, harassing, threatening, discriminatory, obscene, or otherwise unlawful; any content that infringes the intellectual property rights of any person; any content that constitutes unsolicited commercial communications; or any content that discloses the personal data of any other person without their consent.
COMMERCIAL EXPLOITATION WITHOUT AUTHORISATION. You must not use the Platform or any data obtained from the Platform to build a competing product or service; sell, license, or sublicense access to the Platform or any data obtained from it; use educator profile data or school data for unsolicited commercial outreach; or use any data obtained from the Platform in any manner that competes with or undermines the Company's business.
PLATFORM MANIPULATION. You must not artificially inflate verification counts, professional note scores, or any other metric on the Platform; offer or accept any form of consideration in exchange for verifications, professional notes, or follows; coordinate with other Users to manipulate the Platform's trust or ranking systems; or engage in any conduct designed to mislead other Users as to the authenticity or standing of any profile.
The Platform, including its design, architecture, algorithms, source code, user interface, branding, school database, job data aggregation methodology, compensation intelligence system, feed personalisation technology, and all related systems and processes, constitutes the proprietary intellectual property of the Company and is protected by copyright, database rights, trade secrets, and other applicable intellectual property laws of the United Kingdom and international treaties.
The school data compiled and maintained by the Company, including the methodology by which school pages are created, enriched, and maintained, and the longitudinal hiring and network data accumulated through the Platform's operation, constitutes a proprietary database within the meaning of the Copyright and Rights in Databases Regulations 1997. Any extraction or re-utilisation of a substantial part of this database without the Company's prior written consent is prohibited.
Nothing in these Terms shall be construed as granting you any right, title, or interest in the Company's intellectual property other than the limited licence to use the Platform in accordance with these Terms. All rights not expressly granted are reserved by the Company.
You retain all intellectual property rights in Content that you submit to the Platform, subject to the licence granted to the Company in Section 4. By submitting Content, you represent and warrant that you own or have the necessary rights to grant the licence described in Section 4, and that the Content does not infringe the intellectual property rights of any third party.
The Platform maintains profile pages for educational institutions derived from publicly available governmental datasets and other public sources. The Company makes no warranty as to the accuracy, completeness, or currency of institutional data displayed on the Platform. Schools and institutional representatives who identify errors in their institutional page may contact hello@eduatlas.org to request corrections.
By claiming, verifying, or managing an institutional profile on the Platform, a school or institutional representative represents and warrants that they have the authority to act on behalf of the institution, that all information they add or amend is accurate, and that they will promptly notify the Company of any changes to the institution's status, contact information, or other material details.
The Company reserves the right to maintain institutional pages for schools and other educational institutions derived from public sources regardless of whether the institution has actively engaged with the Platform, on the basis of the Company's legitimate interest in providing a comprehensive professional resource for the global education community.
The Platform provides a direct messaging system enabling Educators to communicate privately with one another. Message content is encrypted at rest and the Company is not able to read message content in the ordinary course of its operations. Notwithstanding this encryption, the Company retains the right to access message content where required by law, court order, or where necessary to investigate a credible report of abuse, harassment, or unlawful conduct.
You agree that you will not use the Platform's messaging system to send unsolicited commercial messages, harass or threaten other Users, transmit any unlawful content, attempt to circumvent the Platform's professional context by soliciting Users for purposes unrelated to professional education, or engage in any conduct that violates these Terms or applicable law. The Company reserves the right to suspend or terminate the messaging privileges of any User who violates these provisions.
The Platform operates a pioneer programme for early Educator members and a founding schools programme for early institutional participants. Participation in these programmes grants certain benefits as described on the Platform at the time of participation, which may include priority profile placement, access to beta features, recognition on the Platform's founders listing, and other benefits as determined by the Company from time to time. The Company reserves the right to modify, suspend, or discontinue any benefit associated with these programmes at any time, provided that it will use reasonable efforts to maintain the core recognition benefits (including listing on the founders wall and pioneer status indicators) for the lifetime of the Platform. Programme benefits do not constitute a contractual entitlement to any specific commercial advantage, revenue share, or equity interest in the Company.
The core features of the Platform are currently provided free of charge to Educators. The Company reserves the right to introduce commercial services and fee-bearing features at any time. Where the Company introduces fees for features that were previously provided free of charge, it will give registered Users at least thirty (30) days' advance notice by electronic mail before such fees take effect. Users who do not wish to pay the applicable fee may terminate their account in accordance with Section 14 prior to the fee taking effect.
The Company may offer, now or in the future, any of the following commercial services, each of which shall be subject to such pricing, terms, and conditions as the Company publishes at the time of purchase: (a) institutional access services, enabling schools and other educational organisations to search and access the Platform's educator database for the purposes of recruitment and talent identification; (b) advertising and sponsored placement services, enabling third parties to display advertisements or promoted content to Users of the Platform; (c) research, survey, and market intelligence products, including paid surveys distributed to Educators and aggregated market intelligence reports sold to educational organisations, investors, and other commercial parties; (d) premium profile or institutional listing features; and (e) such other commercial services as the Company may introduce from time to time.
Where the Company engages Users in paid surveys or research studies, participation will always be voluntary and the applicable compensation, if any, will be disclosed prior to participation. Aggregated survey data may be incorporated into commercial market intelligence products sold by the Company; individual responses will not be attributed to any identifiable User in any commercial product.
Where advertising is displayed on the Platform, the Company will not disclose individually identifiable User data to advertisers. Advertising served on the Platform may be contextually targeted based on the general professional context of the Platform but will not be based on the sale or disclosure of individual User profiles or personal data to advertising partners. The Company does not and will not accept payment from any party to promote specific content in a manner that is not clearly identified as sponsored or promotional.
All fees for commercial services will be displayed in pounds sterling (GBP) exclusive of value added tax unless otherwise stated. Value added tax will be added at the applicable rate where required by law. Payment obligations for purchased services are non-cancellable and fees paid are non-refundable except as required by applicable consumer protection law or as otherwise expressly stated by the Company at the time of purchase.
The Company reserves the right to suspend or permanently terminate your access to the Platform, with or without notice, in the event that: (a) you breach any provision of these Terms; (b) the Company reasonably suspects fraudulent, abusive, or unlawful activity associated with your account; (c) you provide false registration information; (d) your account has been inactive for a continuous period of twenty-four (24) months; or (e) the Company determines, in its sole discretion, that your continued use of the Platform is harmful to other Users, the Platform, or the Company.
You may terminate your account at any time by contacting hello@eduatlas.org. Upon termination, your profile will be removed from public view. Certain data will be retained for the period specified in our Privacy Policy and as required by applicable law. Content that has been incorporated into other Users' profiles or that forms part of aggregated analyses (such as anonymised salary data) may be retained in anonymised form following account termination.
Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9, 15, 16, 17, and 18.
The platform is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, the Company expressly disclaims all warranties, whether statutory, express, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company does not warrant that: (a) the platform will be uninterrupted, timely, secure, or error-free; (b) any information obtained through the platform will be accurate, reliable, or complete; (c) defects in the platform will be corrected; (d) any job listing on the platform is genuine, available, or suitable for any particular educator; or (e) any connection made through the platform will result in employment or any other professional outcome.
To the fullest extent permitted by applicable law, the Company shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the platform, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, loss of goodwill, or loss of anticipated savings, whether based on contract, tort (including negligence), statute, or any other theory, even if the Company has been advised of the possibility of such damages.
The Company's total cumulative liability to you for any and all claims arising out of or in connection with these terms or your use of the platform shall not exceed the greater of: (a) the total fees paid by you to the Company in the twelve (12) months preceding the claim; or (b) one hundred pounds sterling (£100). Nothing in these terms shall limit or exclude the Company's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your Content, including any claim that your Content infringes the rights of any third party; (e) any false or misleading information you provide through the Platform; or (f) your violation of the rights of any other person or entity.
The Platform integrates with Google LLC as a third-party authentication provider for the purpose of user authentication. Your use of such third-party services is subject to the terms and policies of that provider, and the Company accepts no responsibility for the practices of third-party providers. The Platform may contain links to third-party websites, including school websites and job listing sources. Such links are provided for convenience only and do not constitute an endorsement, recommendation, or approval by the Company of the linked content, products, or services. The Company accepts no liability for the content or practices of any linked third-party website.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
Before initiating any formal legal proceedings, you agree to contact the Company at hello@eduatlas.org and provide a written description of the dispute, your desired resolution, and your contact information. The Company will use reasonable efforts to resolve the dispute informally within thirty (30) days. This informal dispute resolution requirement shall not prevent either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
Nothing in these Terms shall affect any statutory rights you may have as a consumer under applicable UK law that cannot be excluded or modified by contract, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
ENTIRE AGREEMENT. These Terms, together with the Privacy Policy available at eduatlas.org/privacy, constitute the entire agreement between you and the Company with respect to your use of the Platform and supersede all prior agreements, understandings, representations, and warranties, whether written or oral, relating to the Platform.
AMENDMENT. The Company reserves the right to amend these Terms at any time. Material amendments will be notified to registered Users by electronic mail at least fourteen (14) days before taking effect. Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the amended Terms. If you do not accept an amendment, you must cease using the Platform and may terminate your account.
SEVERABILITY. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the validity and enforceability of the remaining provisions shall not be affected.
WAIVER. The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver by the Company of any breach of these Terms shall be deemed a waiver of any subsequent breach.
ASSIGNMENT. You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
FORCE MAJEURE. The Company shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, industrial dispute, or failure of third-party infrastructure providers.
NOTICES. All notices to the Company under these Terms shall be sent by electronic mail to hello@eduatlas.org. Notices sent to you will be sent to the electronic mail address associated with your account. Notices shall be deemed received on the day of transmission if sent before 17:00 on a Business Day, or on the next Business Day otherwise.
NO PARTNERSHIP. Nothing in these Terms shall be construed as creating any partnership, joint venture, employment, franchise, or agency relationship between you and the Company.
